Rapid Penang to takeover !

Rapid KL will takeover the penang bus service in the name of Rapid Penang... a CNY present for Penangites?

The previous problem of Penang bus system was the licensing control by bureaucrats far away in KL. The setting up of Penang State government owned bus company is perceived as a positive move to divert the power of controlling bus service to the state level, and also to get rid of those notorious bus operators. But now the rapid annoucement of Rapid KL coming in, is just killing the Penang Bus Company before its birth.

Rapid Penang takeover has sparked concerns among the local groups, especially CEPAT (Coalition for Public Transport), a coalition of local NGOs that demanding better public transports for Penangites. One of the major demand of CEPAT is to have local people (public transports users) representation in decision making regarding public transport in Penang. Now, without any mechanism that includes public participation and consultation, another multi-millions project has been contracted out.

Dear Editor,

We refer to the news report on the complaint made by the bus companies against the Penang State Govt over their lack of subsidies. (NST 22/02/07). We don't know on what basis these bus Co's were appointed by the CVLB last February (with great fanfare) but we believe they accepted their contracts which included their obligations as licensees under the CVLB Act, voluntarily . We are unaware of any contractual agreement on the part of the State Govt regarding subsidies for their operations. If they could not operate without such subsidies, they should not have accepted their contracts under those terms.

It is unthinkable that now, after having failed to carry out the terms of their agreement by flouting every condition attached to their licenses at the public's expense, they are trying to blame the Govt for their failure. We can only speculate if this is a ploy to later claim compensation from the Govt for their 'loss of business'!

We are certain that the CVLB that appointed them and their chairman YB Markiman (a member of the legal profession himself) will be fully aware of the terms of the CVLB Act under which they are permitted to operate. Under the statute, not only are they not entitled to compensation but they are actually liable to fines (not exceeding RM10,000) and jail terms (not exceeding 12 months) for breaching the conditions of their licenses. In any case, this complaint should rightly be dealt with by the CVLB to which these operating companies have contractual obligations and not the State Govt. How this matter is resolved will be a matter of public interest because if the CVLB decides to make compensatory payments not only will it be exceeding its own statutory powers but also uding public funds for illegal payments. After allowing these bus Co's to take the State Govt and the people 'for a ride,' to further compensate them using taxpayers money will be like adding insult to injury.
The long suffering citizens of Penang will not be amused!

I refer to the report in the STAR dated 23rd Feb which highlighted complaints by two bus companies against the State Government. We have heard for so many years the numerous complaints made by commuters who have had to endure the pathetic service dished out by the bus operators in Penang. The bus operators never bothered to do anything to improve their services despite being given ample time to do so. Now, when they suddenly realise that an alternative operator may land in Penang and takeover the service, they are crying foul - blaming the State Government for working against them and not living up to their promises! These irresponsible bus operators have no one to blame but themselves. They should not have underestimated the power of the Penang public who have in recent years organised themselves to systematically document and inform the State and Federal government of all the violations that these bus operators committed with impunity. This includes the CEPAT public survey, demonstrations and meetings with the CVLB.

Did the bus operators think they could get away with sub-standard services and Penangites would just sit back and take all that crap? In any case these bus operators do not have any right to ask anyone else to live up to their promises. They seem to always harp on what has been promised to them by the State Government e.g. loans to upgrade the busses. But did they even try and keep the promises they made to the State Government and the Penang public when they were given a 2nd chance in Apr'06? They promised various changes including issuing bus tickets, scheduled bus service and even clean busses! But has this materialised 11 months later? We still have stinking busses waiting at the Komtar terminal for almost 30 minutes, rude drivers and no tickets! They have been judged by the people of Penang and have been found to be utterly wanting. As such, i would say to them this: Your time is up. You have had your chance. Now, get ready to pack up and leave without whining like spoilt child!

Sungai Nyior Toll Defferred

The Butterworth Outer Ring Road (BORR) tolls are starting to collect toll on 21 Feb, except the controversial toll plaza at Sungai Nyior. According to Samy Vellu on 16 Feb, the government has decided to defer the toll collection at the Sungai Nyior toll plaza of the BORR.

This is a victory for the people who protest against the toll, but we shall be watched out, because the federal government only postponed it for the the moment as the protest mounted. We should continue to campaign to get rid of tolls in Penang.

We are also need to start think of stopping anticipated toll invasion on the island.

Outcry against Controversial BORR' Toll

























The road section from Sungai Nyior Toll Plaza to Kubang Semang Toll which 5km in distance, was part of construction of North-South Higway, and then transferred under Butterworth-Kulim Expressway, and now under Butterworth Outer Ring Road(BORR). A new toll plaza has erected at Sungai Nyior after completion of BORR.

Sungai Nyior Toll Plaza will separate the North and South of Seberang Jaya. It is estimated about 150 000 vehicles passing the road daily. The Toll Plaza would affect 300 000 people who stay at Kulim, Bukit Mertajam, Butterworth, Kepala Batas, Sungai Dua and Tasik Gelugor, including working people and students who are going to Penang, Butterworth, Ferry Terminal, Railway Station etc.
Below is the resolution passed during a public meeting on 11 February (in 3 languages).

Kami menyeru kepada Kerajaan untuk melambatkan kutipan tol di Jalan Sungai Nyior atas sebab-sebab berikut:
1. Penduduk-penduduk di Prai dan selatan Kedah telah lama membantah kutipan tol di Sungai Nyior, dan ini telah menyebabkan mereka meminta satu pertemuan dengan Kerajaan; Kutipan tol harus ditangguh sehingga terdapat hasil dari pertemuan tersebut;
2. Toll tersebut akan dikenakan atas suatu jalan yang asalnya tidak ada tol -ini telah mencetuskan bantahan. Setahu kami jalan tersebut adalah sebahagian daripada Jalan Butterworth-Kulim dan telah dipakai lebih 10 tahun. Mengkutib tol di jalan yang asalnya tiada tol adalah tidak munasabah, tidak adil dan membebankan penduduk di Prai dan selatan Kedah;
3. Proses untuk memulakan kutipan tol kurang transparen sehingga penduduk susah dapat maklumat yang berkenaan, kurang fahaman dan seterusnya melahirkan resah gelisah. Wakil-wakil rakyat setempat juga pernah melahirkan bantahan terhadap tol tersebut dan inginkan Kerajaan memberi perhatian kepada pendapat penduduk setempat dan pengguna BKE;
4. Kumpulan kami bersama penduduk di Seberang Prai dan selatan Kadah telah meluluskan satu resolusi di satu rapat umum pada 11hb Fed 2007, diadakan di gelanggang bola keranjang di bangunan Hungry Ghost Festival di Zon A Seberang Jaya, sebulat suara menyeru supaya Kerajaan menunjuk keperhatinan terhadap pendapat penduduk setempat, menjelaskan proses kutipan tol, dan menagguhkan kutipan tol di Sungai Nyior dengan tujuan memansuhkan toll tersebut.

Memorandum:Appeal to abolish Sungai Nyior Toll Plaza
We hereby resolve to appeal for a delay in the starting of toll collection at Sungai Nyior, based on the following considerations:

1.There has been persistent opposition to the toll collection from the public -which lead to a request from residents from Prai and Southern Kedah for a meeting with the State Government; The toll collection should be delayed pending outcome from the meeting;

2. The toll plaza would be built along a non-toll road and this had become controversial; According to our understanding the road concerned originally has been part of the Butterworth-Kulim expressway and had been open to traffic for over 10 years. To collect toll on an originally non-toll roag is unreasonable and unfair, besides being an economic burden to road users in Prai and southern Kedah;

3. The setting up of toll collection at Sungai Nyior lack transparency-causing residents to be unable to access relevant information, un-informed and to start making quesries. The people's representatives within this area had also raised objection to the toll collection and request the relevant authority to heed public opinions;

4. The action committee, together with residents in Prai and southern Kedah, had approved a resolution on Feb 11th 2007 at a public meeting held in a basketball court in Hungry Ghost Festival Association premise, at Zone A Seberang Jaya, unanimously request the government to pay attention to the sentiments of the people, make a full disclosure of the the entire process, and to delay the commencement of the toll collection -with the aim to abolish the toll collection all together.

兹要求在人民反对双溪育收费站,以及由威省及吉南人民组织的反对双溪育收费站联合行动委员会与政府及有关方面进行对话及寻求解决方案前,暂缓双溪育收费站。

双溪育收费站收费站建在原本不收费的公路上,引起非议,据本联合行动委员会了解,该路段原属於北海居林高速大道的部份,同时该也存在逾10多年,在该原来不收费的主干公路设立收费站及收费, 是不合理及不公平的,+++++++(此外据了解,北海居林高速大道已有两个收费站,该收费站应已加入双溪育收费站路段的收费,等於双重收费)++++++++++,这将加重威省及吉南等地区公路使用者及居民的经济负担。

此外双溪育收费站的设立也欠缺透明度,造成人民无法获得应有资讯,对政府批准在该路段设立收费站的行动产生不解及疑问,区内人民代议士及居民也曾提出反对,要求聆听民意。
本联合行动委员会集合威省各地区以及吉南人民,并在2007年2月11日於诗布朗再也A区盂兰胜会有盖篮球场举行的一项汇报会上,一致通过要求政府听取我们的心声,公布收费站始末,以及在处理此事件时,暂缓执行双溪育收费站,并最终废除双溪育收费站。

BN leaders want reasonable toll rates at Sg Nyior Plaza

BUKIT MERTAJAM (Feb 9, 2007): Barisan Nasional (BN) component party leaders have appealed to the central government to consider a reasonable toll rate for motorists using the road that links Seberang Jaya and Butterworth.

A toll plaza at Sungai Nyior has been built to facilitate toll collection from motorists using the road which is part of the Butterworth Outer Ring Road (BORR) project.

Locals were not satisfied with the move to impose the toll, which some believed, would take effect this Feb 16, as the road was an existing one linking the two areas, reports Bernama today.
As such, all the chairmen of BN component parties from Permatang Pauh, Bukit Mertajam, Bagan and Batu Kawan decided to go public and voice out the people's grievances over the situation.

In a press conference attended by the leaders here today, Permatang Pauh BN chairman Datuk Abdul Jalil Abdul Majid said he believed the toll will be a burden to the people there as they used the road frequently to go to work and send their children to school every day.

"The people will not mind paying the toll if it is a new road or an alternative one for them. The problem is the road has been there all this while and they have been using it for free," he said.
He said a letter of appeal had been sent to Works Minister Datuk Seri S. Samy Vellu, and its copies to Prime Minister Datuk Seri Abdullah Ahmad Badawi and Penang Chief Minister Tan Sri Dr Koh Tsu Koon today.

As the ruling party, the BN government must always be sensitive to the people's needs and it was only proper that the appeal received the government's consideration, he said.

Apart from the Sungai Nyior Toll Plaza, two more toll plazas are being built along the BORR stretch in Perai and Bagan Ajam but these two toll plazas involve the construction of new highways.

Butterworth Outer Ring Road toll postponed

SUNGAI SIPUT: Toll for the RM700mil Butterworth Outer Ring Road will only be charged from Feb 20 instead of Feb 15, Works Minister Datuk Seri S. Samy Vellu said Saturday.
Samy Vellu said the extension was made following appeals by Penang Chief Minister Tan Sri Dr Koh Tsu Koon.
The toll rates will be announced on Monday by the ministry's director-general, Samy Vellu added.

Effective last Jan 15, BORR concessionaire, Lingkaran Luar Butterworth Sdn Bhd had opened these new roads for free for one month.

Toll On Butterworth Outer Ring Road Postponed To Feb 20

SUNGAI SIPUT, Feb 10 (Bernama) -- Toll on the Butterworth Outer Ring Road (BORR) in Penang will be imposed only on Feb 20, five days later than scheduled, Works Minister Datuk Seri S. Samy Vellu said Saturday.He said the postponement was made at the request of Penang Chief Minister Tan Sri Dr Koh Tsu Koon.The rate of toll to be collected at three places - Sungai Nyior, Perai and Bagan Ajam - would be announced on Monday by the director-general of the Public Works Department, he told reporters after giving away Chinese New Year gifts to the people, here.BORR concessionaire Lingkaran Luar Butterworth (LLB) Sdn Bhd had opened the 19-km expressway for use free of toll charges for a month from Jan 15.The expressway has six elevated interchanges and a bridge over the Sungai Perai. It begins west of the Jalan Baru Interchange with the North-South Expressway (NSE) and ends at the Sungai Dua Interchange with the NSE.Samy Vellu said more than RM700 million had been spent on the BORR which will help ease traffic congestion as well as facilitate users in getting to the port and the NSE.He said users had the choice of alternative roads if they did not want to use the toll road.Yesterday, the chairmen of Barisan Nasional (BN) component parties in Permatang Pauh, Bukit Mertajam, Bagan and Batu Kawan in Penang appealed to the federal government to consider a reasonable rate of toll on the BORR.They sent their appeal letter to Samy Vellu and copies to Prime Minister Datuk Seri Abdullah Ahmad Badawi and Koh.There have also been protests from several people on the proposed imposition of toll in Sungai Nyior because they claim the road there is an existing one and not new.Samy Vellu also said that he would lead a delegation to Ghana to explore opportunities in the construction industry and infrastructure development in the African country.He said several memoranda of understanding would be signed between the governments of Malaysia and Ghana, which would provide opportunities for Malaysian contractors to participate in development projects in Ghana.Samy Vellu said that after the Ghana trip, the delegation might also visit Kenya to seek similar opportunities.-- BERNAMA
